Family Immigration Cases

There are two ways people might qualify for family immigration, including:

  • Spouses of U.S. citizens, unmarried child (under age 21) of a U.S. citizen, and parents of a U.S. citizen (21 years of age and older)
  • Family preference categories – There are several categories of family preference, including:
    • Unmarried adult children of citizens
    • Spouses and children of lawful permanent residents
    • Married adult children of citizens
    • Siblings of citizens, if U.S. citizen is 21 years old or older

There is not a cap on the number of immediate relatives who can obtain permission to come to the U.S. via consular processing. On the other hand, there are limits to family preference categories and certain categories have long wait times from certain countries.

The goal is to obtain a green card for qualified family members so they can stay in the U.S. as permanent residents. There are different methods of applying for green cards, depending on your situation. 

Spouses of citizens who have been married for less than two years might receive conditional green cards, which expire after two years and have conditions attached. If you have a conditional green card, you must apply for a full green card in the 90 days before your conditional documents expire.
